The St Kitts and Nevis CIU has released new notice on obtaining certificate of no criminal record (PCC-police clearance certificate), which is mandatory for applicants applying for the CBI program.
According to a Notice published by CIU St Kitts and Nevis
The Citizenship by Investment Unit (the Unit) would like to take this opportunity to clarify any misunderstandings with reference to the subject at caption.
According to the Statutory Rules and Orders of No. 52 of 2011, Saint Christopher and Nevis Citizenship by Investment Regulations a police certificate is defined as follows:
“police certificate” means a statement from a national law enforcement authority on the status of a person’s criminal record; “
Police certificates are required for all applicants above the age of sixteen (16) years of age.
Requirements:
- A police certificate is required from your country of current citizenship;
- A police certificate is required from any country you have resided in for more than one (1) year over a ten (10) year period before the time of the submission of your application.
Example:
1. For an application submitted to the Unit in November 2017: A German applicant currently residing in the UAE from 2016;
- a. resided in Germany from October 2007 — June 2011;
- b. resided in France from July 2011 — April 2012
- c. resided in USA from May 2012 — December 2014;
- d. Canada from January 2015 — January 2016
must provide police certificates from the following jurisdictions:
- i. Germany — country of current citizenship and resided for more than one (1) year;
- ii. UAE – resided for more than one (1) year;
- iii. USA – resided for more than one (1) year;
- iv. Canada – resided for more than one (1) year;No police certificate would be required from France.
Exceptions to the requirements:
- No police certificate would be required from your country of current citizenship if you can demonstrate and provide irrefutable evidence that you have never lived there;
- No police certificate would be required if you have renounced your citizenship, evidence of renunciation (renunciation certificate/jurisdictional equivalent) must be provided;
- If you are unable to provide a police certificate; o a separate statutory declaration in both English and the applicant’s own ethnic language, detailing his/her attempts to obtain a police certificate stating whether he/she has been found guilty or convicted of, or charged with offences against the law in any jurisdiction for which he/she is unable to provide such certificate(s), or has not been charged with any offences against the law. o the declaration must be supported by two (2) documents attesting to your character, from reputable members of his community.
Additional information
Correspondence purporting to be police certificates from Embassies or Consulates who are not authorised to issue criminal clearance certificate by their own respective laws will not be accepted by the Unit.
The Unit further advises that special circumstances may apply for individuals who are unable to obtain police certificates. In such cases, Authorised Persons should contact the Verification department directly for clarification and additional guidance.
